“We don’t accept Section 8.” For some Hawaiʻi housing providers, that statement may violate state law. A new complaint filed with the Hawaii Civil Rights Commission alleges five violations at Greystar managed properties across the state, including Kaulana Mahina in Wailuku. The complaint reportedly followed undercover calls in which testers asked whether they could use Housing Choice Vouchers. These are allegations, and the filing does not mean that a violation has been proven. Still, this should be a wake-up call for every housing provider. Act 310 (2022) prohibits covered housing providers from rejecting or discouraging an applicant because they participate in a Section 8 Housing Choice Voucher or permanent supportive housing program. It also prohibits advertising that vouchers are not accepted and imposing different rental conditions on voucher holders. The law does not require you to approve every applicant. Housing providers may still use commercially reasonable screening standards to evaluate income, financial stability, security, and creditworthiness. The important distinction is that the voucher itself cannot be the reason for the rejection. Act 310 (2022) also contains several exemptions, including one that may apply to owners of no more than four dwelling units in Hawaii. Those exemptions are fact specific, so do not assume the law does or does not apply to you without reviewing the details. The practical takeaway is simple. Review your advertising. Use consistent written screening criteria. Train anyone who answers rental inquiries. Most importantly, understand the law before saying no. Despite a slight decrease in median rent, the complaint is still the same, and Hawaii residents are looking to leaders for a solution.
